2022 Legislation Changes



Effective 1 January 2022 any employee who works continuously for 6 hours or more per day is entitled to take a minimum 20 minute rest break.

This is the first time a break during the working day has been a statutory right, although many employers already offer break(s) under the terms of employment.

Also effective from 1 January 2022 the statutory minimum annual leave entitlement increases from 2 weeks per year to 3 weeks per year.

NB: this means that anyone on a zero hour contract must have an increase to their rolled up holiday pay (currently 4%) to 6% as a minimum.

Replacing the '8 hour rule' with a minimum earnings limit. A law change has been passed by the States Assembly in 2021 to make administration of payroll easier.

The current rule will be replaced by a financial limit.

If the employee reaches the threshold then you must pay the primary and secondary contributions. The threshold that you use is determined by the frequency that you pay your employee.

Important information for employers (

  1. MINIMUM WAGE 2022 

The States have agreed the Social Security Minister's proposal to increase minimum wage - again effective 1 January 2022 - to £9.22 per hour; year 1 trainees to receive a minimum of £6.91 per hour and year 2 trainees a minimum of £8.07 per hour.

The offsets for accommodation and/or food have not been increased at this time.

The additional date of Friday 3 June 2022 for the Queen's Platinum Jubilee and the moving of the Spring Bank Holiday from Monday to Thursday 2 June 2022.
